THE FOOZIE'S 12-DAY NAME GAME TERMS & CONDITIONS (“CONDITIONS OF ENTRY”)

Promotional Period: Start date: 12/01/23 at 7:00 am EST. End date: 12/13/23 at 6:59 am EST.
1. How to Enter:
Entry is open to US, UK, CA, AU & NZ residents. Individuals under the age of 18 must have permission from their parent/guardian to participate in this Promotion.
To enter, individuals must check the daily announcements on The Foozie website at 7 am EST and see if their name or a variation is drawn.
2. How to Claim:
If an individual's name is drawn, they must go to the 12-Day Name Game page on The Foozie website, fill in the sign-up form with required details within 24 hours of the announcement. A "gift card code" will be emailed to them at 3 pm EST one day later.
3. Gift Card Code Validity:
The "gift card code" is redeemable for 24 hours from the time it is sent at 3 pm EST. Failure to redeem within this period will result in the invalidation of the code, and the entrant will forfeit the right to the free Foozies.
4. Redeeming the Gift Card Code:
To redeem the "gift card code" for the free Foozies, entrants must ensure that the same email used on the 12-Day Name Game sign-up form is used at checkout. Unverified email addresses will not be eligible for redemption.
5. Eligibility:
The Promoter has the final determination on whether an entrant has a name that matches the drawn name for any particular day, including any variation on qualifying names.
6. Prizes:
Prizes consist of one (1) free pair of Foozies from the entire collection that is available on The Foozie website. The specific design can be chosen by the winner, excluding any exclusions mentioned in these Terms & Conditions.
7. Entries Permitted:
Only one (1) eligible claim per person will be accepted.
8. Prize Value:
The approximate value of each prize is $25 USD. Prizes are not exchangeable for cash or any other product.
9. Winning Method:
Winners will be selected through a random draw from names displayed on The Foozie website at 7 am EST each day.
10. Disqualification:
The Promoter reserves the right to disqualify entries that do not comply with these Conditions of Entry.
11. Privacy:
Entrants' personal information will be collected by the Promoter for the purposes of this Promotion and may be used for future marketing purposes. The Promoter is bound by relevant privacy laws and its Privacy Policy.
12. Liability:
The Promoter and its associated agencies will not be liable for any loss or damage suffered in connection with this Promotion, except for any liability that cannot be excluded by law.
13. Statutory Consumer Rights:
Any guarantee or warranty provided under these Conditions of Entry is additional to relevant statutory guarantees and warranties. Nothing in these conditions restricts, excludes, or modifies any statutory consumer rights under applicable law, including the Competition and Consumer Act 2010 (Cth).
14. Promotion Interruption:
If, for any reason, any aspect of The Foozie 12-Day Name Game is incapable of running as planned, including due to computer virus, communications network failure, bugs, tampering, unauthorized intervention, fraud, technical failure, or any other cause beyond the control of The Foozie, The Foozie may, in its sole discretion, cancel, terminate, modify, or suspend the promotion. This includes invalidating any affected entries or suspending/modifying a prize, subject to State or Territory regulation.
15. Validation of Entries:
The Foozie reserves the right, at any time, to validate and check the authenticity of entries and entrant’s details, including identity, age, and place of residence. If a winner cannot provide suitable proof as required by The Foozie to validate their entry, the winner will forfeit the prize, and no substitute will be offered. Incomplete, indecipherable, inaudible, incorrect, and illegible entries, as applicable, may be deemed invalid at The Foozie’s discretion. Entries containing offensive or defamatory comments, or which breach any law or infringe any third-party rights, including intellectual property rights, are not eligible to win. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid.
16. Dispute Resolution:
In the event of a dispute, the Promoter's decision will be final.
17. Tax Implications:
Winners are responsible for any tax implications and should seek independent financial advice.
18. Rights Enforcement:
Failure by the Promoter to enforce any rights does not constitute a waiver of these rights.
